I Declare herewith that I am a 508(c)(1)(A) TRUST on Earth. And since I hold no citizenship in any country, I and my property and inventions are not subject to any laws of any jurisdiction or land.

The term “508 trust” most commonly refers to a faith-based organization that is automatically tax-exempt under Internal Revenue Code (IRC) Section 508(c)(1)(A) and structured as a trust. Churches and certain religious organizations are automatically considered 501(c)(3) entities without needing to formally apply to the IRS for recognition. 

International Laws and Key Characteristics of a 508(c)(1)(A)

• Automatic Tax Exemption: Organizations that meet the IRS criteria for a church or an integrated auxiliary of a church are automatically tax-exempt under 501(c)(3) status and are specifically excepted from the requirement to file Form 1023 (application for recognition of tax exemption).
• No Application Required: Unlike most other nonprofits, there is no official “508 form” to file with the IRS to obtain this status. The status is granted by law as long as the organization meets the criteria and operates accordingly.
• No Annual Reporting: A qualifying 508(c)(1)(A) organization is not generally required to file annual information returns, such as Form 990.
• Operates for Exempt Purposes: To maintain this status, the organization must operate exclusively for religious, charitable, or educational purposes and ensure no private individuals benefit financially from its earnings (private inurement).
• Freedom of Speech: The 508(c)(1)(A) designation is often promoted as offering greater freedom regarding political speech and lobbying activities compared to a standard 501(c)(3) that must adhere to the Johnson Amendment restrictions.
• Trust Structure: These organizations are often structured as trusts under state law, which helps define their purpose and governance.

• Misunderstanding: The term “508 trust” is less known in the general marketplace, which can sometimes confuse donors or banks who are more familiar with the standard 501(c)(3) designation.
